Weights & Measures license
LICENSE REQUIRED FOR MANUFACTURING WEIGHTS & MEASURES ITEMS
According to Section 19 of Standards of Weights & Measures (Enforcement) Act 1985, no person is allowed to make, manufacture, sell or offer, expose or possess for repair any weight or measure unless he holds a valid license issued for the same.
WHO IS RESPONSIBLE FOR ISSUING THIS LICENSE?
This license is issued by the Controller of State or any other person authorized by him.
WHAT IS THE PROCESS TO APPLY FOR THIS LICENSE?
The applicant should submit an application to Weights and Measures Department in the prescribed proforma i.e. LM-1 along with all supporting documents. The applicant must keep following guidelines in mind:
DOCUMENTS REQUIRED FOR ISSUING THIS LICENSE:
- Proof of the legal title of the premises, attested copy of the sale deed / allotment letter, property tax receipt.
- Rent receipt / NOC from the owner.
- Tools and Equipments list.
- List of testing equipments.
- Copy regarding constitution of the firm.
- Experience certificate.
- M.C.L / Original Lal Dora Certificate.
- Copy of the Literature of the items to be manufactured.
- Proof of financial status.
- Proof for Power Load Sanctioned / Installed / energized by DESU.
- Copy of permanent SSI Registration.
- List of skilled / unskilled workers with their names & addresses.
WHAT IS THE VALIDITY OF THIS LICENSE?
This license is valid for a particular period on payment of fee. It shall be renewed from time to time.
WHICH TYPE OF BUSINESSES REQUIRES THIS LICENSE?
Anyone engaged in business that requires weighing and measuring of products requires this license, such as retail shops, product manufacturers, bakery shops, sweet shops, meat shops, kiraana stores, petrol pumps etc.
HOW MUCH TIME IS REQUIRED FOR OBTAINING THIS LICENSE IN INDIA?
Weights & Measures Department takes 30 days for the issue and renewal of this license.
WHAT IF A PERSON MANUFACTURES WEIGHTS & MEASURES WITHOUT GETTING THIS LICENSE?
The penal provisions for violation of Standards of Weights & Measures Act 1976 and other Act have been laid down in Standards of Weights & Measures (Enforcement) Act 1985. Anyone found violating the guidelines for manufacturing of non-standard Weights & Measures, counterfeiting of seal, short weight /measurement, use of non-verified weights & measures, not making mandatory declarations on the packaged commodities, can have severe penalty on him.
The penalty ranges from Rs.500 to 5000/- and or imprisonment depending upon the nature and repetition of offense committed. The offences which are not compoundable (Section 37 and IInd offense of 39) should be sent to court of law for trial.
Recently, in May this year, the Karimnagar district legal metrology (weights and measures) department in Andhra Pradesh imposed a fine of Rs. 41.74 lakh on various business establishments for violating weights & measures during the last financial year. As many as 1,562 business establishments including jewelry shops were penalized for cheating consumers. The department had also instructed rice millers to correct their weighing bridges immediately.
